Compliance Program Associate Director

Overview:

The Compliance Program Associate Director position is a high-level position in the Compliance Department. This role reports to the Chief Compliance Officer and provides support for the company in implementing, overseeing and managing its comprehensive compliance program, including policies, privacy, investigations, and training.

RESPONSIBILITIES / DUTIES

General Compliance Department Activities - Communications, Policies & Procedures:
·Build strong cross-functional relationships with not only peers but also, executives across the organization
·Provide leadership to departments on compliance review and requirements
·Develop policies and procedures to ensure compliance with applicable laws, regulations and industry rules
·Partners with HR, as needed for compliance matters
·Provide compliance support to employees on privacy matters and questions
·Identify gaps and make recommendations for continuous improvements to the comprehensive compliance program
·Research on new and emerging regulations and practices, assess impact to an organization and recommend necessary changes to relevant policies and SOPs
Monitoring and Auditing Activities
·Member of the Promotional Review Committee to provide review and approval of promotional materials and programs
·Project management of monitoring activities, audits, investigations and other ad hoc initiatives, as directed
·Serve as the key resource for business leaders to investigate issues and support corrective actions and education
·Contribute to the development of risk management strategy and drafting of Enterprise-wide Annual Risk Assessment
·Contribute to the development of the Compliance Annual Workplan
·Partner with General Counsel, International and Global Data Protection Officer on compliance matters.
·Partner with the Legal Department of commercial and clinical contracting, policy development and enforcement, internal investigations, and the like.

Investigations:
·Partner with the Legal and HR Departments on internal investigations. May lead investigation.
·Conducts trend analysis, tracks and report case metrics (including intake, alleged violations, discipline, etc.) and summarizes results for internal reporting purposes (monthly and quarterly)
·Propose the strategy for risk management based on trend analysis of investigations and complaints; may manage implementation.
·Oversee privacy investigations

QUALIFICATIONS:

·Certified in Healthcare Compliance by a national association or academic institution (or equivalent work experience), with at least 10 years relevant work experience with an emphasis on legal/compliance audits and investigations
·Advanced degree required, preferred MBA or JD
·Familiarity with applicable federal, state, and local laws, rules and regulations, some healthcare industry-specific, including FCPA, Anti-Kickback Statute, False Claims Act, Stark, CLIA/FDA and HIPAA; exposure to global regulations (e.g. UK Bribery Act, GDPR, Med Tech) helpful.
·Requires limited direction to complete standard work
·Able to maintain the confidentiality of highly private investigations and other compliance matters
·Experience conducting internal audits and managing recommendation outcomes
·Experience conducting corporate internal investigations including intake, investigation, resolution and written summary reports
·Maintain objectivity and "seek to understand" attitude in investigations to determine root cause and mitigation and corrective action recommendations
·Excellent verbal and written communication skills
·Proficient with databases and case management systems and tools
·Proactive, highly responsive, collaborative, diplomatic, flexible and adaptive
·Ability to work independently and use good judgment while also collaborating frequently across departments
·Excellent communication and interpersonal skills as applied to interaction with coworkers, contractors, supervisors, healthcare professionals and others
·Self-starter without requiring hands-on supervision
·Ability to manage up and work well with executive team members
